Where are Israeli property rights registered?

Before analysing a transaction, locate the record that legally describes the rights.

The Land Registry (Tabu)

A Land Registry extract is an official record of information registered for a property. It may identify the parcel or condominium sub-unit, rights holders, mortgages, cautions and other registered entries. If the property is registered there, the current extract is a central starting point.

Israel Land Authority records

Many properties involve state-managed land and leasehold rights. The Israel Land Authority can issue an authorization of rights or, for some properties, a notice of registration. The ILA itself directs users to Tabu for a property already registered in the Land Registry.

Housing or registering companies

In some projects, a company maintains the operative rights record while registration of a subdivision, condominium or individual rights is incomplete. The relevant confirmation and transfer procedure must then be obtained from that company, sometimes together with ILA material.

  • It determines which record must be reviewed.
  • It affects whether a cautionary note can be registered.
  • It influences the documents, consents and fees required for transfer.
  • It may reveal that the seller holds leasehold or contractual rights rather than registered ownership.
